The Court of Appeal, Akure has ruled that the candidate of the Peoples Democratic Party, PDP, in last September governorship election in Osun State, Senator Ademola Adeleke, is eligible to contest the election.

The court in its ruling dismissed the appeal against the judgment of an Osun State High Court sitting in Osogbo, which earlier nullified the eligibility of Senator Adeleke to contest the governorship election.

It dismissed the appeal on three grounds, thereby affirming the judgment of the lower court that confirmed the eligibility of Adeleke and that the court has jurisdiction to hear the case.

The court also ruled that the petitioner; Kingsley Awosiyan from Ife Central, had no locus standi to file the case and that the matter was brought to court outside the stipulated 14 days after the conduct of the governorship primary election.

Reacting to the judgment, counsel to Senator Adeleke, Nathaniel Oke, Senior Advocate of Nigeria said the latest judgment had knocked out the recent judgment of an Abuja High Court and rendered its conclusion ineffective, null and void.

He explained that the Abuja High Court judgment contradicted the Osogbo High Court verdict by rejecting testimonies of WAEC, which confirmed that Ademola Adeleke sat for its examination with attached results.
