A 39-year-old alleged rapist, Adebayo Akinola has been arraigned before an Osun State Magistrate Court sitting in Osogbo on two counts charge of unlawful sexual intercourse and taking undue advantage of a 16-year-old girl. 

The Police Prosecutor, Mr John Idoko informed the Chief Magistrate that Akinola last week, November 5, 2020 at about 6:30 PM at Ataoja Estate unlawfully had sexual intercourse with a minor by taking undue advantage of her mental and physical condition. 

He stated that the offence committed was contrary to Section 31(1)(2) and 32 of the Child’s Rights Laws of Osun State 2007.

However, the accused person pleaded not guilty to the two counts preferred against him by the police. 

The counsel for the accused, Miss Nkiri Queen made an oral bail application, saying, the accused person is mentally unstable as narrated by his mother. 

The police opposed the oral bail application made by the defence counsel on the ground of the severity of the offence.

The Chief Magistrate, Dr Olusegun Ayilara ordered that the accused person be remanded in Ilesha Correctional Center and adjourned the case to December 9, 2020, for ruling on bail.

An Osun State Magistrates’ Court sitting in Osogbo has sentenced a 22-year-old herdsman identified as Mohamodu Zuberu to four-year imprisonment for kidnapping a 13-year-old boy in the state. 

Upon arraignment on September 3, 2020, the convict had pleaded guilty to a lone charge of kidnapping preferred against him by the police after an interpreter explained his alleged offence to him. 

The police prosecutor, Mr John Idoko said, the Mohamodu on 21st August 2020 at about 3:00 AM at Iwari village via Ikoyi unlawfully kidnapped one minor to an unknown destination in such manner as to prevent any person entitled to have access to him thereby committed an offence punishable under Section 364(2) of the Criminal Code Cap 34 Vol. Il laws of Osun State of Nigeria, 2002. 

The case was adjourned to September 24, 2020 and later to September 30 for presentation of fact. 

While the prosecutor was giving the facts, he tendered a touch light, Phone, Pullover and a stick and he informed the court that the convict demanded a ransom of 2 million naira which was later reduced to 350,000 naira.

The convict begged the court to have mercy upon him for his act. 

The presiding magistrate, Mr Opeyemi Badmus, in his judgment said, with the circumstance of the case and the plea of the accused, the offence of kidnapping had been established against him. 

The court found him guilty of kidnapping the 13-year-old, saying kidnapping or abduction of a fellow human being for ransom is a heinous crime and should not be encouraged in our society and as such Mohamodu Zubaru is sentenced to 4 years imprisonment with hard labor without an option of fine.

The Magistrate Court sitting in Osogbo the state capital has ordered the remand of Niyi Oluwafemi for having carnal knowledge of a 17-year-old girl in Gbongan in Irewole Local Government, Osun State.

According to the charge sheet, the defendant committed the offence on the17th of May at about 10:00am at Oke-Yidi area, Odeomu in Gbongan.

The Police prosecutor, Mr. Idoko John told the court that the defendant did unlawfully have carnal knowledge of one Abiodun Iyanu. 

The offense committed contrary to and punishable under section 358 and 350 of the criminal code cap 34 Volume ll law of Osun state 2002.

The defendant pleaded not guilty to the two counts charges of carnal knowledge and assault leveled against him by the police.

The defense counsel, Mr Tunbosun Oladipupo urged the court to grant his client bail in most liberal terms. 

The prosecutor opposed the bail of the defendant claiming that the victim is in critical situation and receiving treatment in the hospital. 

The Magistrate, Mrs Modupe Awodele ordered the defendant to be remanded in police custody. 

The case was transferred to Gbongan Magistrate court and adjourned the matter till 8th of June, 2020.
