An Ekiti State High Court, Ado Ekiti Division, has sentenced a 49-year-old man, Ademola Akinola, to death by hanging for shooting his elder brother to death and taking away his motorcycle.

Ademola was arraigned in December 2020 for robbing and killing his elder brother, Tunde Akinola.

The charge read, “That you, Akinola Ademola, on November 19, 2019, at Usin Ekiti, in the Ikole Local Government Area of Ekiti State, did rob one Tunde Akinola of his Bajaj motorcycle with registration number ADK 011 VC. At the time of the robbery, you were armed with an offensive weapon, to wit; a gun.”

The charge added that the defendant “on the same date, time and place, did murder the victim, Tunde Akinola”.

An eyewitness, Anike Ogunnusi, who testified before the court, said she and the deceased were going along a footpath on the farm when she saw somebody inside the bush pointing a gun at Tunde.

The witness said, “I shouted, ‘Tunde, run, run, somebody is pointing a gun at you’. Then I took to my heels. While running, I heard a gunshot. I later saw a passerby on the road. When I explained what happened to him, he accompanied me to the scene. On getting there, we met the deceased face down in a pool of blood; his motorcycle had been taken away.”

Another witness testified that “the deceased and his younger brother once had an altercation on the management of their father’s farm property.”

During police investigation, the motorcycle of the deceased was found in his younger brother’s possession; he had changed the number plate. But the discovery was made through the motorcycles’ documents,” he added.

The police prosecutor, Kunle-Shina Adeyemi, said the offences contravened sections 402 (2) and 319(1) of the Criminal Code Law, Cap. C16, Laws of Ekiti State of Nigeria, 2012.

The prosecutor, who called four witnesses, also tendered the statements of the witnesses and defendant, two locally made guns, the photograph of the defendant posing with the motorcycle, motorcycle particulars, and a medical report, among others, as exhibits.

The defendant spoke through his counsel, Olarewaju Oluwasola, and called no witness.

In the court judgment, Justice Lekan Ogunmoye said, “The ingredients of the offences of armed robbery and murder have been established against the defendant. The defendant is accordingly convicted as charged for the offences of armed robbery and murder. The defendant is sentenced to death by hanging on count one (armed robbery) and count two (murder) until he be dead.

An Ekiti State High Court sitting in Ado Ekiti has sentenced a 30-year-old Shola Oguntuase to life imprisonment for raping a 14-year-old girl.

Oguntuase was arraigned before Justice Adekunle Adeleye on one count charge of rape.

In her statement, the victim said, I am a Junior Secondary School (JSS) 3 Student, I was sleeping in our room on that evening, I spread a cover cloth on my body, suddenly, I saw oga Shola (brother Shola) removing the cover cloth on my body and laying on me when I was struggling to stand up and shout, he covered my mouth and nose with the cloth and I could not breathe well, I became weak when he started hitting me with blows on the head, he removed my pant and have sexual intercourse with me, thereafter, he used a white handkerchief to rub my virginal and left.

The offense contravenes Section 31 (2) of the Child’s Right Law, Cap. R7, Laws of Ekiti State.

To prove his case, the prosecutor, Marcus Olowoyo Esq. called four witnesses, and she tendered the defendant’s statements, victim’s statement, and medical report as exhibits.

The convict spoke in his own defense through his counsel Rotimi Adabembe and called no witnesses.

Delivering his judgment, justice Adekunle Adeleye said, from the entire circumstances, I have no doubt that the prosecution established beyond reasonable doubt that the defendant raped the prosecutrix (the victim).

The defendant is hereby sentenced to life imprisonment, the judge ruled.

A 35-year-old Daramola Oyindamola has been sentenced by an Ekiti State High Court to 56 years imprisonment on charges of forgery, fraud, impersonation, and other related offenses.

He was charged and arraigned on a six-count charge of obtaining money under false pretense, stealing, procuring the execution of documents by false, and making documents without authority.

Delivering his judgment, in Ado-Ekiti, on Tuesday, Justice Olusegun Ogunyemi sentenced Oyindamola on a six-count charge from the uncontroverted evidence adduced by the prosecution before the court.

Oyindamola was convicted and sentenced accordingly by Justice Ogunyemi; on count one, 7 years imprisonment, on count two, he is not guilty, on count three, 14 years imprisonment, on count four, 14 years imprisonment, on count five, 14 years imprisonment and on count six, 7 years imprisonment.

The Ekiti State High Court has sentenced one Tunmise Abraham to death by hanging for the murder of his landlady, one Bukola Olanrewaju.

Abraham was found guilty of raping the landlady before eventually killing her at Olorunda Zone 7, Adebayo Area of Ado-Ekiti in 2019.

It was gathered that the late Olanrewaju had demanded rent arrears and electricity bills from the convict before the ugly incident occurred.

The mother of three was at home alone after her husband had gone to work while the children were said to have gone for holiday coaching when the incident happened.

Abraham was alleged to have broken into the woman’s room, threatened her with a cutlass and tied her up before performing the dastardly act.

It was also gathered that after the act, the tenant fled the house but some of his belongings were found in the room which suggested that he was responsible for the act.

The Director of Public Prosecutions, Julius Ajibare, who prosecuted the case for the state government, called four witnesses to prove the case beyond reasonable doubts.

The court presided over by Justice Oluwatoyin Abodunde found Abraham guilty of the offence and sentenced him to death by hanging to serve as a deterrent to others.

An Ekiti State High Court sitting in Ado Ekiti has sentenced two men and two women to death by hanging after being found guilty of murder.

The convicts are Rashidat Abdul thirty seven years, Oluwatosin Akarakiri thirty-two, Abdulrasheed Mutairu twenty two years and Iyoriochile Eromoina eighteen years.

The quartet are to pay the supreme price for the unlawful killing of a seventy-year-old mam, Samuel Oloyede, on fifth of April, 2017 in Odo Owa Ekiti, Ijero Local Government Area of Ekiti State.

Justice Oluwatoyin Abodunde held that the prosecution had proved the case of murder against the convicts beyond the reasonable doubt.

They were first arraigned on the 12th of February, 2018 when the charge was read and interpreted to them but pleaded not guilty.

According to the witnesses, the deceased was a pensioner who operated a brothel in his personal house as a means of livelihood where all the accused persons also lived.

There was a misunderstanding between the deceased and accused persons on payments and sharing formula.

They testified further that the accused persons vacated the premises living the deceased missing and later found his dead body on the 4th day under the heap of cloths with his hands tied.

The matter was reported at the palace and later at Ijero Police Station.

To prove his case, the prosecutor, Oluwatoyin Marcus called 12 witnesses including the Investigating Police Officer (IPO) and the medical personnel who conducted postmortem examination on the cause of the deceased’s death.

Exhibits tendered include statements of the accused, statements of the witnesses, photographs of the deceased dead body and medical report.

The accused persons spoke in their own defence through their lawyer, Chris Omokhafe and called no witness throughout the trial.
