The Supreme Court has upheld the re-election of Rotimi Akeredolu as Governor of Ondo State.

Akeredolu’s victory was affirmed after four of the seven justices of the Supreme Court that heard the case upheld his candidacy in the October 10, 2020 election in the state.

Three other justices disagreed with the majority judgment, insisting that Akeredolu’s candidacy in that election was a nullity.

The minority judgment held the view that the appeal has merit and ought not to be struck out by the Appeal Court.

Akeredolu was the candidate of the All Progressives Congress, APC, in October 10, 2020, Governorship election in Ondo State.

The PDP and its candidate, Eyitayo Jegede had earlier approached the Appeal Court to challenge the candidacy of Akeredolu, insisting that his nomination form was signed by a sitting Governor Mai Buni who doubles as the Acting National Chairman of the party.

The appeal was based on the constitutional provision which forbids sitting Governors from holding executive positions outside their statutory position as governors.

They prayed the court to nullify Akeredolu’s candidacy, but the Appeal Court struck out the appeal, for lack of merit.

The All Progressives Congress, APC, in Oyo state has alleged that Governor Seyi Makinde and the leadership of the Oyo State Independent Electoral Commission, OYSIEC, were out to waste the state’s scarce resources and also make a mockery of democracy and the rule of law with their plans to go ahead with the conduct of the local government election slated for Saturday, May 22, without the APC and other registered political parties.

The Caretaker Committee Chairman of the APC in Oyo state, Chief Akin Oke, stated this at a press briefing held on Wednesday, at the party’s new state secretariat, Oke-Ado, Ibadan.

Chief Oke said it became compulsory for him to once again address the press on the deliberate and unconstitutional acts of OYSIEC which has excluded the APC from the local government election.

The APC Caretaker Chairman recalled that the court action of the members of ALGON in Oyo State challenging the unconstitutional dissolution of the duly elected executives of the 33 local governments and 35 local council development areas in the state was finally laid to rest by the Supreme Court judgment of May 7, 2021.

He said: ”One of the reliefs granted at the High Court among others was a perpetual injunction restraining the defendants in that case among which is OYSIEC or anybody whatsoever from conducting elections into the 33 LGs and 35 LCDAs and their councilors during the three years constitutionally guaranteed tenure of the chairmen.”

“It would also be recalled that the All Progressives Congress was the political party through which platform the chairmen and councillors contested and won the elections in 2018 and it therefore stands logic on its head for the chairman of OYSIEC who is a senior lawyer and a Senior Advocate of Nigeria for that matter to assert that APC cannot seek to benefit from a pronouncement of the Supreme Court of Nigeria and we have to wonder why cases are being cited in court or what do lawyers mean by the doctrine of judicial precedent.”

“It will be a situation of approbating and reprobating for the APC to field candidates during the pendency of a litigation instituted by its members and what the lawyers call subjudice which should tell the OYSIEC chairman who is a lawyer that parties are supposed to know that nothing should be done with respect to a matter already submitted for the adjudication of the court.

“It must also be noted that OYSIEC had in its guidelines imposed a nomination form fees of N250,000 and N100,000 to be paid by the chairmanship and councillorship aspirants respectively. These fees are illegal because election processes cannot be monetised. OYSIEC having realized this illegal imposition of fees have now decided to refund the candidates but not after OYSIEC had closed every avenues for participation in the electoral processes thereby shutting out so many citizens of Oyo State who would have participated in the election by seeking for political office but for the illegal imposition of the nomination fees.”

“The question is, is it fair on the people for OYSIEC to refuse to extend the election period and allow those already shut out from participating to also have the opportunity to exercise their constitutional rights to seek elective offices? We hope that Oyo State Government and OYSIEC will have a rethink and allow reason to prevail.”

Chief Oke revealed that APC has prepared its originating processes and same forwarded to the Chief Judge of Oyo State through party’s lawyers.

Adams Oshiomhole, a former National Chairman of the All Progressives Congress, APC, has identified the cause of banditry and insecurity in Nigeria.

Oshiomhole said the closure of factories and retrenchment of workers in Nigeria was the major reasons for banditry and general insecurity in the country.

He stated this at the 2nd Nigeria Labour Congress, NLC, National Peace and Security Summit in Abuja, yesterday.

The former APC National Chairman also noted that non-payment of the N30, 000 new minimum wage President Muhammadu Buhari signed into law was also responsible for lack of peace in the country.

He said: ‘’Who are the bandits? I suspect that those 35,000 workers whose factories have been closed in Kaduna city, those whose livelihood have been taken away, what are they doing?

“What will their children and grandchildren be doing now? It’s common sense to know that an idle mind is the devil’s workshop.

“I suspect that those Nigerians that we abandoned and not providing for them, as you can call them almajiris or beggars have all grown up.

“When you talk about unemployment, the biggest problem is having the biggest population of unemployable.

“When they deny workers such payment, can there be peace? I submit with the International Labour Organisation, ILO, that the condition for national peace and security does not necessarily need much bullet but decent jobs.

‘’But when you are at an environment where jobs are being killed, jobs that do not exist cannot even be decent.”

Banditry, kidnapping and general insecurity is currently on the rise across Nigeria.

While bandits are abducting and killing students in the North, unknown gunmen are attacking security personnel and government institutions in the Southeast.

Killer herdsmen are creating havoc in some states like Benue, Taraba and some parts of the Southeast

In his reaction to the purported suspension of Governor Kayode Fayemi by an unknown group, the Chief Press Secretary to the Governor, Mr Yinka Oyebode, described it as a joke taken too far.

Oyebode said the All Progressives Congress (APC) as a party is governed by laws, adding that members of the group cannot hide under their recent suspension to announce a dubious suspension they lack the locus to handle.

While one would have dismissed their claims as another failed attempt to polarise the party in the state, it is also important to put it on record that the action of the group smacks of criminal impersonation as none of those who signed the purported suspension letter were executive members of the party at ward, Local government or state level.

The action is but a joke taken too far as they never had such power they want to arrogate to themselves while they were members of the party, much less now that they have been suspended.

Governor Fayemi however remains unperturbed by this antics of suspended members.

Well-meaning members of the public as well as members of APC are urged to disregard the news of the purported suspension as it only exists in the imagination of members of the group.

Dr Kayode Fayemi remains the indisputable leader of the APC in Ekiti State.
