A court in Norway has sentenced a doctor to 21 years in prison for the rape and sexual abuse of dozens of women, in a case that has shocked the Scandinavian country.

Former GP Arne Bye has been convicted of 70 counts of rape and sexual assault. He was also convicted of 82 counts of abusing his position as a doctor, Norwegian media reports.

Nearly all of the offenses took place during medical examinations that Bye carried out on his patients while he worked as a physician in the small town of Frosta – a tiny community of fewer than 3,000 residents, near Trondheim on the west coast of Norway.

Bye was also banned from practising medicine and ordered to pay compensation.

The court had deliberated over a lengthy indictment, which included allegations spanning nearly two decades relating to 94 women, according to Norwegian media.

Bye pleaded guilty to some of the crimes, and was also acquitted on a number of the charges.

Addressing the court in Trondheim on Friday, Judge Espen Haug said the case was “very serious” and described Bye’s actions as “absolutely unacceptable”.

“The defendant’s actions happened in a place and setting where people are supposed to feel safe,” Judge Haug said. “His actions have undermined public trust in the health service as well as doctors in general.”

The 55-year-old defendant stood on his feet, appearing calm and unmoved as the maximum sentence was handed down.

The courtroom was then asked to sit as it took more than an hour for the judgement to be read out.

Health authorities had first alerted the police to concerns about Bye in August 2022, and he was charged a year later.

Bye had secretly installed a camera in his office, Norwegian media reports. Police uncovered the scale of his offences after reviewing hundreds of hours of footage.

Dozens of women, reportedly aged between 14 and 67, from the small, rural community came forward. The earliest complaint dated back to 2004, the most recent from 2022.

Central to the case had been the methods Bye used for medical examinations.

Over four months, the court heard details of non-consensual touching and inappropriate pelvic examinations conducted by Bye.

These act constitute rape under Norwegian law, which makes a distinction between penetrative and non-penetrative rape.

Bye was also shown to have used non-medical equipment, such as a deodorant, during these exams, with no justification for doing so.

The defence attorneys had sought a lower sentence of around 17-18 years as Bye had pleaded guilty to the rape of 21 victims.

Bye’s lawyer also said he would take some time to read the verdict properly before considering whether to appeal.

Two teenage sisters were arrested in Pakistan for killing their father by setting him on fire in revenge for rape, police said Wednesday.

The father was attacked in the Punjabi city of Gujranwala on January 1 and taken to hospital where he died on Tuesday.

“The girls said that they decided betweent them to find a ‘permanent solution’,” Rizwan Tariq, a senior police official in the city, told AFP.

Their mothers — who are both married to the man — knew about the abuse but did not know of the revenge plan.

AFP has not named the man in order to protect the identities of the girls, one of whom is from a previous marriage.

One of the wives has also been arrested while the second is being questioned.

“We expect to present them before the court in a few days, as soon as we finish the investigation,” Tariq added.

Former Brazil international football player Robinho has been arrested to serve a nine-year prison sentence for rape.

He was convicted two years ago in Italy for his part in the gang rape of an Albanian woman at a nightclub in Milan in 2013.

Robinho, 40, was arrested at his flat in his home city of Santos.

The Italian government had requested that he serve his sentence in Brazil after failing to get him extradited.

On Wednesday, a court in Brazil upheld the decision and also ruled that he should serve his time behind bars instead of under house arrest.

Earlier on Thursday, a Supreme Court judge rejected a request to halt his detention.

The decisive action taken by Brazil’s justice system has been praised by many in local media, who feared that Robinho would evade justice thanks to his fame and his wealth.

The former Brazil international, who has 100 caps for his country, was playing for AC Milan at the time of the crime. After being found guilty, he lost an appeal in 2020 before Italy’s highest court upheld his sentence in 2022.

Italian prosecutors then issued an international arrest warrant for him.

The footballer, who spent two years with Manchester City, told a Brazilian network on Sunday that the sex had been “consensual”.

Funmi Adekoya in this piece examines sexual and gender-based violence and Child Early and Forced Marriage as social menace that require concerted efforts to checkmate

Sexual and Gender-Based Violence, SGBV, is any harmful act perpetrated against a person’s will, and that is based on socially ascribed differences between male and female.

These include rape, domestic violence, sexual exploitation, trafficking in persons and harmful traditional practices.

According to data from the Nigerian National Population Commission, NPC, Gender Based Violence, experienced by Nigerian women throughout their lifetime, from either their present husband, is put at 19% for demonstrative or emotional violence, 14% for physical violence, and 5% for sexual abuse.

Also, data on different forms of violence against women submitted by United Nations (UN) human rights bodies shows that 22.3% women experience Lifetime Physical and/or Sexual Intimate Partner Violence, while 13.8% experience Physical and/or Sexual Intimate Partner Violence in the last 12 months. The record also indicates that Child Marriage is 43.4%, Female Genital Mutilation/Cutting is 19.5%.

Ending Sexual and Gender-Based Violence (SGBV) and Child Early and Forced Marriage (CEFM) are complex and multifaceted tasks that require collective efforts from individuals, communities, governments, and organizations.

However, identifying and addressing the underlying factors that contribute to SGBV such as poverty, unequal power dynamics, and lack of access to resources and education, is key to mobilizing communities to actively address SGBV by organizing workshops, discussion forums, and events focused on raising awareness and promoting collective responsibility.

Little wonder experts on Sexual and Gender Based Violence and Child Early and Forced Marriage are calling for collaborative effort to identify best practices and evidence-based approaches.

According to the Coordinator, Care-Fronting Nigeria, Dr. Maji Peterx, government at all levels should ensure implementation of policies against Sexual and Gender Based Violence.

He advocated fostering international cooperation to combat cross-border Sexual and Gender Based Violence, human trafficking, and other forms of violence that impact vulnerable populations.

“What we are looking at is the mobilization of critical mass of people to buy into the idea that we are all in this together, the issue of Child Early and Forced Marriage (CEFM) and Sexual and Gender Based Violence (SGBV) is not a one-man thing, it is an everybody thing.”

Dr. Peterx emphasized the need to enact comprehensive laws and initiate policies that address SGBV including laws against domestic violence, rape, and sexual harassment, and particularly enforcing the laws, while the legal system should also be sensitive to the needs of survivors and perpetrators are held accountable.

He called for policy formulation towards achieving gender equality in all aspects of life including education, employment, decision-making roles; challenging and dismantling patriarchal systems that perpetuate violence and discrimination

“Promote gender equality by engaging men and boys in discussions about challenging harmful masculinity, stereotypes and promoting healthy, respectful attitudes towards women and girls. Encourage male allies to speak out against SGBV and take an active role in creating safe communities.”

Dr. Peterx said the media had key role to play through reportage of SGBV cases while avoiding sensationalism and victim-blaming narratives, and as well utilizing media platforms to raise awareness and promote positive messages about respect, consent, and equality, which is very important.

“We must capitalize on the power of the media to give us this narrative that would raise awareness and consciousness. We the Civil Society must design a pattern for advocacy to get more people to understand our advocacy, so that they will know that if we don’t deal with SGBV and CEFMit, they will deal with us. We can therefore all work together to bring an end to it.”

Dr. Peterx added “I think many at times, government look for short time solution to a long time problem. We need bills and policies to ensure that gender issue is a structural and systemic issue, so that when government is making policies, it would be a law that protects the lives of all.

“Although, government is signatory to Act, international convention, do they implement and enforce? That is why we want government to see to the implementation of treaty they are signatory to.”

While corroborating the opinion of Dr. Peterx, Program Manager, International Federation of Women Lawyers, FIDA Nigeria, Mr. Fikih Obaro highlighted some keys steps to end Sexual and Gender Based Violence, Child Early and Forced Marriage.

“I think what is critical is behavioural change. Behavioural change is key towards ensuring that we have effective solution on SGBV and CEFM, and what that means is, basically we need to go back to the root, we need to go back to the community, we need to sensitize person, we need to provide avenue where people can change their behaviour from being perpetrator or being abusive to being supporters structurally for survivors of Gender Based violence.

“So sensitisation is key to behavioural change, advocacy is key towards achieving behavioural change. There has to be concerted advocacy from the grassroots down to upper echelons towards ensuring that we have a society that responds positively to Sexual and Gender Based Violence”.

Mr. Obaro called for provision of accessible and survivor-centered support services including counseling, medical care, legal aid, and safe shelter for survivors of SGBV, with survivors encouraged to come forward by reducing stigma, victim-blaming, and ensuring their safety during the reporting and investigation process.

“In terms of reintegration of survivors back to the society, Obaro said it is key that Nigeria has a victim protection approach and victim protection system whereby survivors of Sexual and Gender Based Violence are being reintegrated back into the society without fear of stigmatisation.”

“We need to create safe homes, we need to create effective shelter, we need to create safe avenues so that they can have succour an enabling environment for them to be empowered and be gradually reintegrated back to the society “.

In his own contribution, Program Coordinator, Child and Youth Protection Foundation, Mr. Olatosimi Kolawole called on civil society organizations to collaborate with government in the implementation and monitoring of policies on Sexual and Gender Based violence.

“The first thing we need to do as CSO is to recognize that government have policies that addresses the issue of Sexual and Gender Based Violence, understand the provision of these policies and understand that we need to start engaging with government to have a budget head for the implementation.”

“Implementation is vital, and I know that CSOs can push for the implementation of these policies and monitoring the implementation of the policies. When this is done we will see that government policies are actually speaking to the yearning and aspirations of the people.”

Mr. Kolawole said CSOs should regularly evaluate the effectiveness of SGBV prevention and response initiatives and make necessary adjustments based on feedback and data.

“Remember, ending SGBV is an ongoing process that requires each person’s actions, no matter how small, to contribute to a safer and more equitable world.”

By Olaitan Oye-Adeitan

Has the girl child now become nothing other than an object to be shredded rather than treasured, valued and nurtured?

This question is borne out of the fact that hardly would a day pass without reports of sexual harassment in the form of rape or defilement as the case may be.

On a daily basis, the media is  awashed with stories of the girl child being raped. Little girls even as young as one month to five years old equally go through the agony of defilements.

It baffles one however that perpetrators of this dastardly act are fathers, brothers, uncles, guardians, neighbors, teachers and head teachers alike.

These are people who ordinarily should protect, guide and care for these innocent, lovely and beautiful beings.

Like a lion laying in wait for its prey are rapists in their evil scheme to pounce on an innocent girl who goes through her day unsuspecting of a hunter that may have laid ambush for her.

A rapist and his victim

And the hunters hide even in the most unimaginable places; the schools, church, houses of  neighbors or among relatives.

The victim is now left to bear the physical and psychological trauma which ,if not properly managed could leave on her,a permanent scar.

So, where then is safe for the girl child?
Perpetrators when they have succeeded in carrying out their nefarious act even go to the extent of threatening to kill their victim if she dared to expose them.

While some victims come out of this experience alive,it is unfortunate that some lose their lives in the process, without getting justice, leaving on the heart of the victim’s family, double loss and sorrow.

Unfortunately, if ever caught and charged to court, the rapist on many occasions is granted bail due to weak legislation on rape issues.
This inflicts more wound in the heart of the victim.

While the law stipulates a twenty years imprisonment for rape cases, it is however sad that very few offenders had been made to serve the prescribed jail term, making others to keep mute on it.

If the dignity, welfare and future of the girl child would not be left in jeopardy, it is high time the law began to take its full course on rapists, by punishing culprits regardless of whose ox is gourd.

Parents must be alert and curious of unfolding events around and behavior of their children. They should give their little girl the freedom of expression anytime she wants to discuss with them.

Often times, many kids are left to nurse their pains silently alone due to refusal of their parents to listen to them and erroneous belief that a child has no issue of concern.

The custody of these children is equally vital, especially when parents are not around.Any unusual closeness or attachment from neighbors, friends or unknown individuals with the girl child must also be investigated by parents and challenged where necessary to avoid unsuspecting danger.

It is advisable that parents do not overlook the importance of educating their female child on the realities of life and how to blow the whistle in case of rape attempt.

The community  also has the responsibility of keeping an eye on activities and movements around them so as to quickly expose any shady or unwholesome act.

Everyone should bear in mind that the child you save today may just be your only hope of tomorrow and a future beacon of her society’s progress and development.

A man, identified only as Kayode, has committed suicide after his neighbour’s daughter accused him of raping her twice at their house in the Oja-Amukoko area of Lagos State.

It was was gathered that the victim’s mother, who had a stroke, was taken to the Ikorodu area for treatment.

The suspect, who was put in care of the 16-year-old at home, was said to have taken advantage of her.

Her father said she accused Kayode of raping her twice, adding that he also seized her phone to prevent her from informing her family members.

He said, “My daughter stays with her mother, as both of us are no longer together. My ex-wife had been suffering from a stroke and from what we gathered, she had a neighbour, Kayode, who had been assisting to take care of her.”

“But when my ex-wife’s sickness worsened, she was taken to Ikorodu for treatment and her daughter also followed her. As time went on, the neighbour had to go there to bring my daughter back to her mother’s house around Campus, Amukoko, so she could continue schooling.”

“But she suddenly left her mother’s place and came to my place on Ojo Road. She said she wanted to continue staying with me till her mother recovered. About 20 minutes after she came, Kayode also came to my place and started saying he knew my daughter’s behaviour better than I did.

“He said if she was no longer staying at her mother’s house, he would have to return her to her mother in Ikorodu since he was the one who brought her home. He also said she came to stay at my place because she wanted freedom to go out and that he never had any agreement with her mother that she would be staying with me.”

After speaking with his ex-wife, the victim’s father said Kayode took his daughter back home but a few days later, he received a call from his ex-wife’s younger brother, who told him to go home to rescue his daughter.”

He said, “I quickly rushed there, but I didn’t meet her at home. I called my ex-wife’s younger brother and he said he would soon join me at the place.”

After a few minutes, I saw my daughter and she informed me that Kayode raped her. She said she could not sleep alone in her mother’s apartment and that when she slept at Kayode’s apartment, he raped her twice and seized her phone.”

“It was when she told Kayode that she wanted to contact her mum that he released his phone to her and instead of calling her mum, she used that opportunity to text her mum’s younger brother.”

“So, we went to a police station and she explained to the policemen who said they could not hear only our side of the story. We went to pick up Kayode, but didn’t meet him at home. The policemen then directed us to do a medical test at Orege General Hospital. We were also asked to return the next day as they searched for him.”

A 23 year old lady, Zainab Oladehinde, has narrated how she was almost raped in her hotel room in Zanzibar, Tanzania.

Oladehinde, on her Twitter page, also shared videos and photos to back up her story.

She wrote, “it’s high time I told my horrible experience in Zanzibar as a young solo female traveler”.

She said this incident happened a year ago, but she hasn’t been able to talk about it because she has been in therapy as she was healing from psychological trauma.

“On the 15th of April 2021, I flew from Lagos, Nigeria to Zanzibar, Tanzania for my 23rd birthday and I was extremely excited about it. I had my reservations about going to a foreign country as a solo female traveler, but none of my thoughts would have prepared me for what I eventually witnessed and experienced in Tanzania.”

She revealed the 2-day flight had a one day transit time in Addis Ababa, Ethiopia but she arrived at her hotel where she booked a 6night accommodation.

“At around 12am, a few friends and family called to wish me a happy birthday and then I went back to sleep. Few hours into my sleep, I felt a strange hand touching my breast.” Now, this was me sleeping naked on my bed in my hotel room with my doors locked, so this was definitely a dream. I told myself and went back to sleep.”

“Some few minutes afterwards, I felt my hands stroking someone’s p*nis. At this moment, I opened my eyes to confirm if it was actually a dream or I was in real danger. Low and behold, it wasn’t a dream. There was a naked man lying on my bed and touching me at 2am in my hotel room! He started calling me baby and then I became scared cause the room was dark as I had switched off the lights before I went to bed.”

She described how the stranger wanted to force himself on her, but she had to lie that she had HIV so he could leave her alone, especially as he couldn’t understand English but was speaking Swahili to her. She noticed that at the mention of HIV he paused, so she kept mentioning it whilst crying, telling him to go get a condom, which he agreed to and immediately he left, she ran out of her room to go call for help.

She reported to the police the next day even though the hotel manager and owner, who she called, hadn’t reached out to her yet. She was asked to write a statement and advised that she goes to a hospital for a checkup. She also stated that they were asking her questions instead of interrogating the suspects “When I decided to take a picture of the police station and the statement I had written, the policemen started shouting at me and threatening me to delete the pictures I have, I stood my ground and said I wouldn’t delete any picture.”

“When we got to the hospital, the nurse confirmed that there was no penetration. I got back to the police station, and the policemen said they have no issue for the sexual assault since I wasn’t raped. That’s the only issue here was my stolen money”

She shared pictures and videos of the suspects, police officers and the police station

News Analysis

According to a survey in 2018 by Nigeria demographic and health, thirty percent of girls and women aged between fifteen and forty-nine suffers sexual abuse.

The survey sates that at least two million girls experience sexual abuse annually and that only twenty-eight percent of cases is reported while only twelve percent result in convictions.

Available records show that a good number of suspected rapists move freely on the streets after committing the heinous act.

Also worrisome is the fact that not much is being done in respect of strengthening the law to incisively deal with perpetrators of rape.

Rape victims suffer a sense of abuse that goes beyond physical injury. They may become skeptical of men and experience feelings of embarrassment and disgrace. Victims, who suffer rape trauma syndrome experience physical symptoms such as headaches, sleep disturbances and fatigue.

The weak stance of the law towards rape needs to be seriously addressed. Women and girls who are raped have little hope of obtaining justice and reparation. Victims are sometimes pressured into withdrawing the case or parents of victims prefer financial settlement out of court to a criminal prosecution.

Such as the case of a grandmother who was recently arrested for allegedly collecting fifty thousand naira bribe from a man, Seun Olarewaju, for raping her three year-old granddaughter to cover up the crime.

Where cases are brought to court, prosecution sometimes fails because police refer cases to a court lacking appropriate jurisdiction and progress is then obstructed by the slow administration of the judicial system. In some cases, the alleged perpetrator is charged with a different and less serious criminal offence.

The nation’s justice system should be strengthened to enforce

The child rights act which provides that sex with a child is rape and anyone who has sexual intercourse with a child is liable to imprisonment for life upon conviction to serve as deterrent to others.

Commendably, the Nigerian governors’ forum has strongly condemned all forms of violence against women and children and pledges commitment to ensuring that offenders face maximum weight of the law.

Furthermore, the ministry of women and social welfare should up its game by liasing with relevant authorities to find lasting solutions to rape issues.

The boy child from a tender age must be taught respect and dignity for women while musical videos and films depicting women as mere sex symbols should be reviewed.

It is essential to recognise the need to provide emotional therapies for survivors in the nation’s hospitals.

Rape is never the fault of survivors; they live with the shame and guilt and often find it difficult to forgive themselves.

Knowing this, therefore, family support and favorable environment is needful to promote the healing process which is often slow while linkage with a support group is essential to encourage experience sharing and eventual recovery.
