Osun State Election Petition Tribunal sitting on the petition of Governor Gboyega Oyetola against the declaration of Ademola Adeleke as the Governor-Elect has adjourned to Tuesday, October 4 for the proper commencement of pre-hearing.

The adjournment followed the decision of the tribunal to grant INEC, PDP and Adeleke 7-days to respond to the pre-hearing form served on them by the tribunal.

At the sitting of the tribunal, counsel to the All Progressives Congress (APC), Professor Kayode Olatoke (SAN) informed the court of his readiness to continue with the pre-hearing session, having filed his form TF008, where issues for determination were raised.

At the request of the tribunal for advice, Olatoke suggested that the matter should be stood down for a few hours for the respondents to also respond to the tribunal pre-hearing form.

Counsel to the INEC, Ben Ananaba (SAN) said the pre-hearing could not go on because he was just served with the pre-hearing form that morning, saying statutorily, they had seven days to respond.

Counsel to Adeleke, Bamidele Abolarin and counsel representing PDP, Nathaniel Oke (SAN) also requested the tribunal to give them the required seven days to respond.

In his ruling, the Chairman of the tribunal, Justice Tertsea Kume adjourned the matter till Tuesday, October 4 for the commencement of the hearing properly.

Addressing journalists after the sitting, Professor Olagoke said the adjournment was not out of place, but the tribunal had the power to abridge the days required for any of the parties to respond.

“We were supposed to commence the Pre-hearing session this morning but unfortunately the respondents said they were served with the pre-hearing notice this morning.

“Form TF007 will inform the parties, while TF008 is the one they are going to respond to. But they said they served them this morning and for that, they have to respond; but election petition being too sui generis and time-sensitive that is why we were suggesting we can take a stand down for them to fill the forms so that we come back for pre-hearing in the afternoon but since they insisted on having their right.

“But in order to be fair to them, that was why the tribunal adjourned till next week for them to take their time, fill the form and come back for pre-hearing session.”

However, the Osun State Government accused the Minister of Interior, Ogbeni Rauf Aregbesola for allegedly invading the state capital with armed thugs, shooting sporadically into the air to scare innocent people away from their businesses.

In a statement, the state Commissioner for Information, Mrs Funke Egbemode said “credible reports confirmed that some misguided cowards invaded Osogbo, the Osun State capital with armed thugs to foment trouble”.

“Their interest is simply to attempt to thwart the peace of the state and create fear in the minds of the good people of Osun counting on a long-lost influence.”

The statement adds that “Government of Osun hereby warns that there are no sacred cows in the state. No one is above the law here regardless of their past glories or future aspirations. Security agencies have been well briefed about the activities of these mischief makers, who have set themselves on a collision course with the law”.

The Federal High Court sitting in Osogbo has declined jurisdiction in the case of aggrieved members of the Osun State All Progressives Confess, seeking to invalidate the ward, state and local Congress of the party held in July.

The aggrieved members who are members of The Osun Progressives, TOP, loyal to the minister of Interior, Ogbeni Rauf Aregbesola had approached the Federal High Court seeking an order to invalidate the election and affirm its own members as the authentic executive of the party in Osun State.

In an application brought before the court, 2,517 persons who described themselves as aggrieved members of the APC against the party’s caretaker leadership, Governor Gboyega Oyetola and INEC, claimed that they paid to the designated Banks but were denied access to the purchase of the form by the Governor and the then APC caretaker Chairman in Osun, Prince Gboyega Famoodun.

However, the defendants filed a preliminary objection challenging the jurisdiction of the Federal High Court to hear the matter on the ground that it fell exclusively under the purview of what the Electoral Law and decisions of the Supreme Court contemplated as party’s internal affairs.

Ruling on the preliminary objection of the APC and INEC, Justice Emmanuel Ayoola remarked that having not participated in the congress as contained in their originating summon, the aggrieved members lacked the justification to seek to invalidate the process.

Justice Ayoola also took a swipe at one of the claims of the plaintiff seeking to be declared as the validly elected executive of the party during the Congress, as he declared that they had no such status to enjoy such declaration.

Speaking further, the Jurist noted that, “the Supreme Court had said the court could not dabble into the internal dispute of party unless it fell under Section 87(9) of the Electoral Act. In the instance case, the plaintiff does not qualified to be called an aspirant and was not a candidate in the said congress based on their own affirmation”.

Citing a plethora of Supreme Court cases, Justice Ayoola said the fact of the dispute did not fall under S. 87(8)) of the Electoral Act and Section 251 of the Constitution.

He stated further that “the case of the plaintiff is not covered by the law and cannot be adjudicated by the court. All reliefs sought against the first to the fifth defendants do not affect federal agencies but State hence should be filed at state high Court”.

On the whole, the Court in striking out the suit ruled that “the suit as constituted was defective for making allegations against persons, especially Governor, Alhaji Isiaka Adegboyega Oyetola who were not made parties to the suit, failure to properly institutes the suit in a representative capacity as those represented are imprecise, nebulous indescribable and undeterminable; and purely a hypothetical disputes that is academic or moot”.

Mr. Oyetola noted that it was in the realization of historical economic benefits of the sector that his administration had been putting in place necessary infrastructures and enabling environment for not only the textile industry, but also other sectors of economic importance to thrive.

He said no one could underplay the pivotal role the sector played in stemming the tide of unemployment between late 1950s and early 1990s and this has precipitated the efforts of the current administration to make this sector thrive among many others for sustainable socioeconomic development.

The governor hinted that his administration’s declaration of every Thursday being “Osun Adire Day” and the directive that all public and civil servants be dressed on Adire the said day, was in furtherance of efforts not only to promote our culture and tourism but also, to specifically develop the state textile industry.

The initiative of establishing an International Trade Centre in Dagbolu was part of the concerted efforts towards sustainable industrialization and commercialization, noting that the inland port would greatly help the state in strengthening importation and exportation of goods such as textile products as well as giving the state businesses an international exposure.

Earlier in her remarks, the President, Osun State Textile Dealers, Mrs. Misturat Adedapo who spoke on behalf of other members, appealed to the government to consider them for more value added benefits such as intensive loan facility and grants which could bring about a drastic development of their industry.

Mrs. Adedapo equally commended the administration of Governor Oyetola for abolishing the single uniform policy in the state education sector, saying reverting to the old school uniforms has indeed improved their businesses which had been negatively affected before.

She also eulogized the focused leadership and managerial prowess of the governor, which she said has brought about a tremendous development to all sectors of the economy.

Politics

Osun state Governor, Mr Gboyega Oyetola, has again appealed to members of the ruling All Progressives Congress, APC, in the State to give peace a chance and allow the ongoing appeal process run its full course.

Mr Oyetola also condemned what he described as “unruly behavior” exhibited by some aggrieved members of the party at the APC Secretariat in Osogbo, saying no sane society would condone any act of lawlessness.

The Governor therefore directed security operatives to take charge of the party secretariat to prevent any further break down of law and order.

While sympathising with individuals who sustained injuries, he called on security operatives to fish out perpetrators and ensure justice was served.

In a press statement by his Chief Press Secretary, Ismail Omipidan, on Saturday, the Governor noted that Osun and its people are known for peace and urged all to avoid acts that could tarnish the State’s reputable image.

He further noted that political intolerance was injurious to the unity and collective peace of the State.

While appealing for calm, the Governor also said that government would not tolerate any act of criminality or violence in any part of the State under the guise of politics or any guise whatsoever.
